SUBJECT OF THE ONLINE CONTRACT AND ITS DEFINITION

An online sales contract shall mean a distance contract, that is, a legal transaction concerning movable goods and/or services concluded between a supplier, Azienda Agricola Montecastelli, Via Strada di Pieve a Castello n. 10, 53035 Monteriggioni (SI), VAT No. 00915480529, and a consumer customer within the framework of a distance selling system organized by the supplier who, for this contract, uses exclusively the remote communication technology known as the Internet, through the website corresponding to the address www.shop.montecastelli.com.

The consumer customer shall mean the natural person who purchases goods and/or services from the seller’s website.

By placing an order through the various methods provided, the customer declares that they have read all the information provided during the purchase procedure and fully accept the general terms and conditions of sale set out below.

The contract shall be concluded upon the acceptance of the Order Receipt by the customer by clicking the button labelled “Confirm Order” at the end of the purchase procedure.

By accepting the “Order Confirmation”, the customer also confirms the unconditional acceptance of the terms and conditions of sale reported herein.

These terms and conditions of sale shall remain effective until modified by the supplier. Any amendments to the terms and conditions of sale shall become effective from the moment they are published on the website www.shop.montecastelli.com and shall apply to sales carried out from that moment onward.

SALE PRICES, VAT AND SHIPPING COSTS

All sale prices of the products displayed and indicated on the website include VAT at 22%, 10% or 4%, depending on the product category in accordance with Italian legislation.

The above-mentioned taxes apply to all countries of the European Community.

For sales outside the European Community, any additional costs due to taxes and customs duties provided for by the legislation in force in the destination country shall be borne by the consumer.

Shipping costs are calculated automatically based on weight and shipping method and can be viewed directly on the website.

DELIVERY TIMES

Most of the products are available in our assortment. This means that delivery times may vary from 3 working days to a maximum of 5 working days, starting from the date the ordered goods are delivered to the courier.

During the Christmas holiday period, delivery times may extend to 5 to 7 working days.

If the order concerns items that are temporarily unavailable on the website and/or in stock, the customer will be promptly informed of the expected shipping time. Shipping will always take place once payment has been confirmed.

The customer will be promptly notified of the shipment of the processed order via email, which will include the parcel tracking code where available.

DELIVERY METHODS

When home delivery is requested by the customer, the ordered goods will be delivered by Mailbox or by various courier services.

Under no circumstances will shipments be made to P.O. boxes, mailboxes or similar addresses.

PAYMENTS AND SECURITY

Payments can be made by bank transfer to the details that will be communicated after order confirmation, or by credit card (Visa or Mastercard), or via PayPal.

In order to guarantee the security of the transmission of confidential data, our website uses the most well-known and established protocol for secure web transactions: Secure Socket Layer (SSL).

SSL technology ensures that confidential data travels on the Internet only in encrypted form, thus guaranteeing that it cannot be read by third parties.

WARRANTY

The European 2-year warranty refers to the lack of conformity of a product and not to the duration of the warranty relating to the malfunction of the product (which is declared directly by the manufacturer).

The 2-year conformity warranty protects the consumer by ensuring that the specifications of the purchased product correspond to what has been declared by the seller, namely its physical, internal, external, performance and usage characteristics.

If this is not the case, the consumer may return the product to the seller and obtain either a refund or an alternative product, provided that the packaging and characteristics of the product are preserved and the item has not been damaged.

RIGHT OF WITHDRAWAL AND REFUND

Pursuant to Legislative Decree 206/2005 and in implementation of European Directive 97/7/EC, Azienda Agricola Montecastelli informs all its customers that they may exercise the right of withdrawal without providing any reason within 14 days from the receipt of the goods.

To exercise this right, the customer must send a registered letter with return receipt within 14 days from receipt of the goods to:

This communication may be anticipated via email at info@shop.montecastelli.com, provided that it is confirmed by registered mail within 48 hours.

The returned goods must be packed in suitable packaging to ensure their integrity.

The shipping costs for returning the goods shall be entirely borne by the customer, who is responsible for them from the moment they are delivered to the courier until they arrive at our premises.

The returned item must be intact in all its parts and returned in its original packaging, otherwise the right of withdrawal shall be considered void.

After verifying the integrity of the goods, we will refund the amount paid for the purchase of the goods, excluding shipping costs, as soon as possible via bank transfer and in any case within 14 days from receipt of the withdrawal communication.

PRIVACY

Privacy Policy pursuant to Legislative Decree 30.06.2003 n. 196.

Personal data will NOT be used for sending advertising material, promotions, newsletters or similar communications unless explicit consent has been given.

The customer’s personal data received during registration will be used strictly to fulfill contractual obligations, process the order and carry out the necessary communications with those who provide delivery services and accounting services for our company.

Such data are processed electronically in compliance with current legislation and may be disclosed only upon request by judicial authorities or other authorities authorized by law, as expressly provided for in Legislative Decree 196/2003.

FISCAL DOCUMENTATION

For every purchase, Azienda Agricola Montecastelli always issues a regular fiscal receipt and/or invoice using the data entered by the customer in the relevant form.

OBLIGATIONS OF THE BUYER

The buyer is strictly prohibited from entering false, invented or fictitious data during the registration procedure required to activate the process for the execution of this contract and related communications.

Personal data and email addresses must correspond exclusively to the customer’s real personal data and not to those of third parties or fictitious persons.

It is expressly forbidden to create multiple registrations corresponding to a single person or to enter data belonging to third parties.

LIABILITY OF THE SELLER

Azienda Agricola Montecastelli shall not be liable for any disruption attributable to force majeure events such as discontinuation of product manufacturing, accidents, explosions, strikes and/or lockouts, earthquakes, floods or other similar events that prevent, in whole or in part, the execution of the contract within the agreed time.

Azienda Agricola Montecastelli shall not be liable to any party for damages, losses or costs incurred as a result of the non-execution of the contract for the aforementioned reasons or for the non-acceptance, even partial, of an order. In such cases, the customer shall only be entitled to the refund of the price paid.

JURISDICTION AND COMPETENT COURT

This contract concerning the application, execution, interpretation and violation of purchase contracts concluded online through the website www.shop.montecastelli.com is governed by Italian law.

In the case of a consumer user, the competent court shall be the court of residence or domicile of the consumer, if located in Italy.

For any other dispute, the competent court shall be the Court of Siena.
